Class A, B & C Drug Allegations

The substance and the alleged offence both matter. Contact Ghafar Khan about a controlled-drug investigation without assuming that classification alone tells you the outcome.

Drug classes and examples

Government guidance lists cocaine, heroin and MDMA among Class A drugs; cannabis and ketamine among Class B drugs; and benzodiazepines and nitrous oxide among Class C drugs. This is not a complete list. The exact substance and applicable law must be checked.

Class describes the legal classification of a substance. It is separate from the alleged offence, the quantity and a person’s role. Tell Ghafar what appears on the charge sheet or laboratory report rather than relying on a street name.

Class A allegations

For an allegation involving cocaine, crack cocaine, heroin or MDMA, identify whether the case concerns possession, supply, a conspiracy or a border offence. The defence discussion should be directed to that allegation rather than treating every Class A case in the same way.

If more than one substance is alleged, list each charge and identify the material that relates to it. A large investigation may contain different periods, defendants and exhibits. Clear organisation helps keep your own position in view.

Class B and Class C allegations

Cannabis, ketamine and prescription-drug cases can raise very different factual issues. Explain the source of the item, any medical context and the documents available. Do not assume that a medicine, a lower class or a small quantity means there is no legal issue.

Lawful prescribing, licensing and particular exceptions require attention to the exact circumstances. Keep prescriptions and relevant correspondence available for advice. Do not use a general table as permission to possess, share, import or export a substance.

Choosing the right guide

Use the possession guide for a personal-possession allegation, the PWITS guide where an intention to supply is alleged, and the conspiracy or organised crime guides for a wider case. The importation and exportation guides address UK border allegations.

For your first call, give the offence, substance if known, current stage and next date. The legal team can then discuss what is needed to assess the case and agree the scope of any representation.

Class A, B & C Drug Allegations — frequently asked questions

Is drug class the same as my role in an offence?

No. Classification concerns the substance; role concerns a person’s alleged conduct and responsibility. Both need to be considered in their proper context.

Can I call before a laboratory result is available?

Yes. Explain what you have been told and which documents exist. Do not guess the result.

Are prescription medicines always outside drug law?

No. The exact medicine and circumstances matter. Tell your solicitor about prescriptions, possession and any alleged transfer or border movement.
