Drug Importation Defence
Contact Ghafar Khan about alleged involvement in bringing controlled drugs into the UK, including parcel, passenger, vehicle and freight investigations.
Identify the border allegation
Controlled-drug importation cases may involve the prohibition in section 3 of the Misuse of Drugs Act 1971 and fraudulent-evasion offences under section 170 of the Customs and Excise Management Act 1979. The precise charge and alleged knowledge matter. An intercepted consignment does not by itself resolve the legal position.
Tell Ghafar which agency contacted you, where the interception occurred and whether the allegation concerns a completed movement, an attempt or an agreement. Provide the actual paperwork rather than relying on an informal description of smuggling.
Parcels, addresses and logistics records
Prepare a chronology of relevant orders, deliveries, employment or travel. Identify who controlled an address, account, vehicle or booking and what records show the arrangements. If the prosecution relies on a collection or delivery, explain the instructions you received and the context.
Describe available documents before sending them: tracking records, booking confirmations, invoices, work records and communications may need to be considered together. Preserve the original records and ask how they should be transferred.
Your position within a wider investigation
An importation case may be linked to alleged onward supply or a wider conspiracy. Ask which part of the movement you are said to have known about and which acts are attributed to you. Explain any disputed attribution to a device, business or person.
If a hearing or interview is approaching, telephone with the date first. Where another solicitor is instructed, any proposed review and transfer need proper arrangements. The fact that a case involves overseas material does not remove the need for a focused account of your own position.

Drug Importation Defence — frequently asked questions
Can I enquire if a parcel was addressed to me?
Yes. Explain what correspondence or interview request you received and what you know about the address and delivery. Avoid assuming the address alone answers the allegation.
What if the consignment was intercepted?
The interception and the precise charge require legal advice. Do not assume the absence of a completed delivery ends the case.
Can I discuss an alleged courier role?
Yes. Provide the alleged journey, your account and the next date. Role and knowledge need individual assessment.
