Alleged Organised Crime Group Defence
Being described as part of an organised crime group is a serious allegation. Contact Ghafar Khan to discuss the evidence said to connect you to the group and your own position.
An allegation must be assessed against you
An investigation may use an OCG label while charging conspiracy, supply or another offence. There is also a separate participation offence under section 45 of the Serious Crime Act 2015, involving participation with the required knowledge or reasonable suspicion. Establish which offence is actually alleged.
A case overview may describe a hierarchy, a network or a series of operations. Ask which acts, communications and dates concern you. Do not assume that a description of the whole group establishes the same responsibility for every defendant.
Testing alleged connections and roles
A useful review starts with the links relied on: personal contact, premises, vehicles, accounts, transactions or communications. Record the lawful context you can explain and identify disputed links. Say clearly where you have no personal knowledge.
If a chart places you in a particular position, ask what supports that placement. Discuss attribution of phones, nicknames and encrypted accounts, including any change over time. The evidence needs to be considered with the full chronology rather than only a diagram or selected extract.
Large bundles and individual instructions
Explain the scale and format of the material and the current hearing timetable. The team can discuss how to organise a review, which issues need priority and whether specialist input should be considered. Do not send a full prosecution bundle through an initial WhatsApp message.
Different people in the same investigation can have conflicting interests. Tell Ghafar who else is involved and which lawyers already act. Availability and conflicts must be assessed before representation is accepted.
When the alleged role is disputed
The prosecution may allege leadership, coordination, recruitment, finance or distribution. Your account should address the actual conduct and time period. If sentencing becomes relevant, the factual basis and role assessment require advice alongside any plea decision.
Raise coercion, vulnerability or exploitation privately and promptly. Their significance depends on the facts and applicable law. A claim of pressure should be examined carefully rather than reduced to a label or treated as an automatic answer.

Alleged Organised Crime Group Defence — frequently asked questions
Does an OCG label mean I am charged under section 45?
Not necessarily. Check the charge sheet or indictment. The label may appear in an investigation involving other offences, including conspiracy or supply.
What if the prosecution calls me an organiser?
Tell Ghafar which acts are relied on and which you dispute. A description of your role needs to be examined against the evidence and your instructions.
Can a family member make the first call in a large case?
Yes, for practical arrangements. Confidentiality, the client’s instructions and conflicts govern what can be discussed and accepted.
Can Ghafar discuss an existing multi-defendant trial?
Enquire with the court, next date, current representation and a brief description of the material. Any review or change of representation needs to be agreed properly.
