Drug Offence Roles & Sentencing Preparation

Accused of organising an operation, managing a line or acting as a courier? Discuss the evidence and the factual basis before decisions about plea or sentencing.

Leading, significant and lesser role

The adult supply and PWITS guideline assesses culpability through leading, significant and lesser roles alongside harm. Role indicators include the level of control, function, expected benefit, awareness and pressure. A job description such as courier does not determine the category by itself.

Ask which guideline applies to the charged offence and which findings are proposed. Drug class, harm and role are different questions. The court’s assessment depends on the accepted or established facts rather than an online label.

LeadingCommercial direction; influence within the chain; links to the source; substantial expected advantage.Which decisions did you make? What supports the claimed authority or benefit?
SignificantOperational management; involving others; financial motivation; some understanding of scale. What was your function, what did you understand and over what period?
LesserLimited activity under direction; pressure or exploitation; little awareness of scale; limited expected advantage. What direction or pressure existed? What records support your account?

These are examples, not a complete checklist. The applicable guideline and all relevant circumstances require assessment.

Organisers, managers, couriers and people under direction

If the allegation is that you organised others, identify the decisions and instructions said to show that. For an operational or delivery role, explain the tasks, period, payment and level of choice accurately. Tell the solicitor what you understood about the wider activity.

Raise threats, dependency or exploitation and identify any existing supporting records. The position may change over time, so do not compress a long period into one description. Your solicitor can discuss how disputed facts should be addressed.

Preparing for sentencing without guessing an outcome

Bring the charge, prosecution summary, plea position and any proposed factual basis to the discussion. Identify disagreements about quantities, dates, benefit or conduct. Advice should address those issues before assuming that sentencing preparation is simply a collection of character references.

Ask what personal information and documents are relevant, how to provide them and when they are needed. Health, responsibilities and other circumstances should be accurately evidenced where appropriate. No website can predict the sentence in an individual case.

Liability and sentence are separate decisions

A dispute about guilt is different from a dispute about the role of a person being sentenced. If you are considering a plea, obtain advice about both the offence and the facts on which the court would proceed.

This guide concerns adult drug-offence preparation. Different principles apply to children and young people. Tell Ghafar the defendant’s age and the next hearing date when making contact.

Drug Offence Roles & Sentencing Preparation — frequently asked questions

Does being a courier automatically mean lesser role?

No. The guideline assessment depends on the actual function and circumstances. A label alone does not settle the issue.

Does being accused of belonging to an OCG automatically mean leading role?

No automatic category should be assumed. Discuss the evidence about your own conduct, responsibility and understanding with your solicitor.

Can I ask about a disputed prosecution account before pleading?

Yes. Provide the proposed account and explain each disputed point. Obtain individual advice before making a plea decision.

Can you tell me my sentence from the quantity alone?

No. The relevant guideline and individual facts need assessment, including role and other applicable factors. Contact Ghafar with the actual papers.
