Possession with Intent to Supply Defence
Accused of possession with intent to supply, often called PWITS? Contact Ghafar Khan to discuss what the prosecution says demonstrates an intention to supply another person.
Possession and the alleged intention
Section 5(3) concerns possession of a controlled drug with intent to supply it unlawfully to another. The alleged intention is a distinct issue from possession. A defence discussion should identify what is accepted, what is disputed and what the prosecution relies on to support that further allegation.
Avoid assuming that one detail determines the outcome. Give the full circumstances of the recovery and the account you have already provided. If personal use is relevant, explain that privately to your solicitor rather than trying to estimate an acceptable amount from an online guide.
Reading the material together
Ask for advice about the relationship between the recovered items and any phone, financial or surveillance material. A useful preparation plan identifies which device is attributed to you, the relevant period and the records needed to understand the allegation.
Where a prosecution summary uses terms such as deals, stock or tick list, distinguish the underlying exhibit from the interpretation placed on it. Tell the legal team what you recognise and what requires explanation. Preserve original material and avoid editing screenshots.
From a search to the next hearing
Tell Ghafar whether you are awaiting interview, on police bail, charged or already in Crown Court proceedings. Provide the next date and any restriction affecting access to your documents. The immediate work should be tied to that stage.
If you want advice about a plea or sentence, provide the prosecution’s factual account. Do not accept a disputed role or quantity simply because you are considering a guilty plea; the position needs individual legal advice.

Possession with Intent to Supply Defence — frequently asked questions
Is PWITS the same as simple possession?
No. PWITS includes an allegation of intention to supply another person. The distinction should be addressed against the evidence in your case.
Can I discuss a personal-use explanation?
Yes. Give your solicitor an accurate account, including what you have already said to police. Do not rely on a fixed quantity from a website as a defence.
Can Ghafar review phone evidence in a PWITS case?
Enquire with the stage of proceedings and a description of the phone material. The scope of review and any specialist assistance can then be discussed.
